Zelmo, not having one of these here blog thingies to vent out with, and jonesing for the blogging fix available hereabouts (Z doesn't get out much, plus his bosses are assholes so they probably block the good sites like Atrios or Cute Overload)
So he emails me. Hoping, apparently, to kick me out of my cold medicine coma long enough to blurt something into the ether, to be roundly ignored unless I manage to insult some half-assed 70's MOR band.
Ooops. got off track there. It's late.
Anyways, I got this from ol' Z:
Does this mean I can shoot them as they enter my house?Referring, of course, to the recent ruling by The George W Bush Totalitarian Creation Institute and Hunting Club. I mean the Supreme Court. That places a warrant and police action above any privacy or property right you might think you have. Welcome to Russia, comrade. The State has no interest in you if You Are Not Doing Anything Wrong, and if we have to break your doors down to prove it, well, you can't make an omelet without breaking a few heads. Eggs. Whatever, they crack real good with these nice sticks.

Interestingly enough, he's not the only one who thinks that way: At TPMCafe, a lawyer named Nathan Newman is of the opinion that this doctrine is on a course to crash into the Castle Doctrine, in such a way that some very ugly cases are on their way.
Unfortunately, and apparently of no interest to Justices Roberts, Breyer, Thomas, and Alito who are not particularly worried about a few deaths on one side or the other, if they can bring their Corporate-Autocratic Nirvana one step closer to reality.
Note: This problem is already being well explored by the case of Cory Maye. If you think his race does not play a factor in the way this case is being pursued, I'd like to talk to you. Very slowly, quietly and calmly, while the sharp implements are removed from the vicinity. But overall, it does not bode well for the civilians.
There. The good old Random tomorrow, but probably late.
I can hear the same argument being made that justifies each reduction of individual rights....if you're innocent, then you have nothing to worry about.
ReplyDeleteInnocent and white, that is.
Half-assed 70's MOR band? That's an oxymoron.
ReplyDeleteI just can't think of any.
Turns out the knock-and-announce rule is based on English Common Law going back to the 13th frickin century!!!

Used to be Conservatives stood for tradition, not trashing it.
